At the back of the newspaper, in the Deaths/Notices section it is common to see notices published by executors/lawyers seeking to obtain a grant of probate for the administration of the estate.
You probably won’t be seeing this anymore.
From 24 November 2017, it will no longer be a requirement to publish a Notice of Intention to Apply for Grant in a newspaper.
Publication requirements are still required in the Queensland Law Reporter.
s67 Trusts Act Statements
However, a section 67 Trusts Act 1973 (QLD) Statement published separately from a Notice of Intention to Apply for a Grant will still need to be published in a newspaper.
The relevant laws applicable to the new amendments are:
Section 252 of the Court and Civil Legislation Amendment Act 2017 (Qld), which amends section 67 of the Trusts Act 1973 (Qld):
The Uniform Civil Procedure (Notice of Intention to Apply for Grant) Amendment Rule 2017 which amends Rule 599 of the Uniform Civil Procedure Rules 1999 (Qld) (UCPR); and
Supreme Court of Queensland Practice Direction 14 of 2017.
