Man sues for gender discrimination when less qualified female gets job - Wins $390,000

A male government official successfully sued the State when his job application was rejected in favour of a less qualified female. It appears the decision to favour the female was based on the under-representational of women in the particular work category and an attempt to socially engineer change.

The decision of the Federal Administrative Court in Austria accords with a "merit based" approach to employee selection and will not be welcomed by "affirmative action" advocates.
