5 Steps to a Successful and Swift Family Law Property Settlement

A common frustration in family law claims is that property settlements can take years to finalise.

Here are 5 steps to a swift property settlement:
Step 1 - Formulate a percentage range of the property division which is backed-up by legal precedent, and the contribution factors under the Family Law Act 1975 (Cth);
Step 2 - Create an action plan and set a 30 day timeframe for your opponents to respond and agree to;
Step 3 - If negotiation is futile, immediately move to a Mediation if your opponent's range is outside your predicted range. Convene the Mediation within 30 days to minimise unnecessary delay;
Step 4 - Issue a final offer of settlement which, if not accepted, can be relied on to claim costs against your opponents; and
Step 5 - Be ready to commence proceedings if the Mediation fails and a negotiated settlement is unlikely.
Following these steps will more often than not result in a resolution within months, rather than years.
