Case Study: Intersection of Business Law and Family Law

Our client approached us with concerns that her husband had inappropriately gifted away her shareholding in their family business, to the effect that the wife’s interest in the business was reduced down to a minimal percentage.


Upon further investigation it was revealed that shareholding had been surreptitiously stripped away to another company operated by the husband.


The husband’s failure to rectify the wrongdoing prompted us to issue proceedings seeking an urgent injunction restraining the husband from further dealing with the assets of the business.


We were successful in obtaining the appropriate restraint orders, thereby protecting the wife’s interest in the business and preserving the property pool for their family law separation.
