Family Law has been a no-fault area of law since the introduction of the Family Law Act in 1975. The Court will not be interested in issues of infidelity (except in cases of "wasted funds"/negative contributions to the asset pool).


Instead, the Court will apply the fundamental 4 step process to determine a just and equitable result between the parties, having regard to issues such as:-


  • The income of both parties;

  • The financial and non-financial contributions of the parties;

  • Each party's future needs and ability to earn future income;

  • The future needs of the children of the marriage/relationship.
